Access to justice in the context of corporate abuses: litigation as a strategy of resistance and empowerment of victims (ACCJUSTEDH)

Summary of the research project: Adverse impacts of business activities on people and the environment often affect the enjoyment and exercise of human rights recognized in international instruments and in the domestic legal systems where businesses operate. These negative impacts have given rise to numerous judicial and non-judicial procedures to hold companies responsible for their actions or omissions, as well as to ensure that victims obtain comprehensive reparation for abuses suffered. This project aims to analyze to what extent strategic litigation in business and human rights serves as a measure of resistance and empowerment for victims and as a catalyst to articulate political and legislative actions to ensure respect for human rights and environmental protection in the context of business activities.

 

Objectives:

Objective 1. Mapping obstacles and outcomes of strategic litigation of human rights abuses and environmental impacts in the context of business activities.

Objective 2. Examining the extent to which human rights and environmental due diligence policies and regulatory frameworks guarantee victims of corporate abuse access to judicial and non-judicial redress mechanisms.

Objective 3. Formulating proposals to empower and guarantee access to justice for victims of corporate abuses within the framework of the implementation of policies and regulatory frameworks regarding mandatory due diligence in human rights.
